1.2 Non-Owner-Occupied Properties Only
Lendyx provides financing only for non-owner-occupied investment properties. We do not originate loans secured by property that is, or will be, used as the borrower’s primary residence, second home, or otherwise for personal use.
1.3 Borrower Representations – Purpose and Occupancy
By submitting an inquiry, prequalification request, or loan application through this Website, you represent, warrant, and covenant that:
• (a) Any requested credit is solely for business or investment purposes and not for personal, family, or household use;
• (b) The proceeds of any loan obtained from Lendyx will be used only for business or investment purposes; and
• (c) Any property pledged as collateral will not be occupied by you or any member of your immediate family as a primary residence or second home, and will be held for business or investment use.
You understand that Lendyx will rely on these representations in evaluating your eligibility for credit, and that any misrepresentation of the loan purpose or occupancy status may constitute fraud and may result in denial of credit, acceleration of any indebtedness, default remedies under applicable loan documents, and/or other legal and equitable remedies.
